Tenant compensation for legionella infestation

The elimination of the Legionella is a defect removal. The landlord is responsible for the removal of defects, unless the tenants have culpably caused the defect.
However, this is not to be assumed in cases of legionella infestation.
If the landlord is responsible for the removal of defects, he must also bear the costs.
The tenants can therefore demand reimbursement of the costs or demand that these water consumptions are taken into account in the water billing (utility bill).
